No published survey directly measures regret among divorced adults who lacked a prenuptial agreement; the ~15% inaction figure shown here is a constructed proxy, inferred from prenup-adoption and attitude data rather than a retrospective regret question. LawDepot’s own survey reports adoption, not regret (85% of ever-married respondents said they had never signed a prenup). The action side is harder still to pin down, because no published survey measures regret among people who actually signed a prenup. What the literature does measure is the perception cost of asking: in a Harvard study by Heather Mahar, 63.7% of the general public said they would believe divorce was more likely if a partner asked them to sign a prenuptial agreement. These two numbers measure different things — a perception about a request versus a retrospective regret among the divorced — so the gap between them is directional context, not a clean like-for-like comparison.

Prenup adoption has risen sharply even as the signaling stigma persists: a 2022 Harris Poll found 15% of married or engaged Americans had signed one, up from just 3% in 2010. The American Academy of Matrimonial Lawyers reported in 2016 that 62% of its member attorneys had seen increased prenup requests in the prior three years, with the most common provisions being protection of separate property (78%) and spousal-maintenance terms (74%). The practical implication is that the process matters as much as the outcome: a prenup negotiated with independent counsel for each party and finalized well before the wedding is less likely to read as the distrust signal that the Mahar perception figure captures.

The main methodological caveat is that the action-side number is a perception proxy, not a direct regret question, and almost certainly overstates the relational cost actually felt once an agreement is in place. The inaction-side 15% is a constructed proxy rather than a measured regret rate — no survey asks divorced adults whether they regret not having had a prenup — so it should be read as a rough, adoption-and-attitude-derived estimate; the true inaction-regret rate across all married couples (most of whom remain married and may be disproportionately low-asset or low-conflict) could be lower still. The stakes of a prenup decision are sharpest for couples with separate pre-marital assets, business ownership, or children from prior relationships; for most first-marriage couples with similar financial starting points, the practical consequences are modest.

Relabelled 2026-06-30 after grounding review. No published survey measures regret among people who actually signed a prenup, and the prior action-side "8% trust damage among signers" figure was not traceable to any cited source (fabricated). The action-side relational cost is therefore restated as the PERCEPTION cost that the literature does measure: Heather Mahar's Harvard study found 63.7% of the general public would read a partner's prenup request as a signal that divorce is more likely. This is a signaling/perception construct, NOT a post-signing regret rate; proxy_only is set true and the caveats and prose note the construct mismatch explicitly. 56.04% of surveyed law students gave the same answer, and an earlier survey found 62% thought a prenup request "sends a negative signal about the future of the marriage."

    計算過程
Grounding fix 2026-07-01: the prior excerpt claimed LawDepot found "fifteen percent of people whose marriage ended in divorce report regretting the absence of a prenuptial agreement" plus a regret-by-assets breakdown. Neither sentence appears on the live LawDepot page, and the "[full text paywalled]" framing was false (the page is a free public article). Re-verified 2026-07-01: LawDepot surveyed 547 participants and reports that 85% of ever-married respondents never signed a prenup and cites a 2022 Harris Poll (15% have signed a prenup, up from 3% in 2010). LawDepot reports NO divorced-regret figure. The widely reproduced "15% of divorced adults regret not having a prenup" claim is an untraceable orphan statistic with no identifiable original survey — it appears only in family-law marketing blogs and likely garbles the Harris Poll 15%-have-signed adoption figure. The inaction regret_rate (0.15) is therefore retained ONLY as a transparent constructed proxy (see regret_display), NOT as a measured divorced-regret rate; no direct regret survey for this side exists.

注意事項

The two sides measure DIFFERENT constructs and are not strictly comparable. No published survey measures regret among people who actually signed a prenuptial agreement, so the action side reports a PERCEPTION proxy instead: Heather Mahar's Harvard study found that 63.7% of the general public would read a partner's prenup request as a signal that divorce is more likely. That is an attitude held by the broad public about a hypothetical request, not a regret rate among signers, and it likely overstates the relational cost actually experienced once an agreement is in place. The inaction-side 15% from LawDepot is framed as a direct divorced-adult regret figure but could not be verified in the current LawDepot survey page and is widely reproduced secondhand; it is also an underestimate of any all-couples rate since only people who divorced are surveyed. Both figures are most meaningful for couples with significant separate assets, business interests, or children from prior relationships; for median-income first-marriage couples, prenup decisions carry less financial consequence. Because the action proxy (a public perception) and the inaction proxy (post-divorce regret) are not the same kind of measurement, the headline gap should be read as directional context, not a precise like-for-like comparison.
